1. Introduction
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and 99 Dollar Holidays Pvt. Ltd. ("Company," "we," "us," or "our") concerning your use of the Ride With Driver platform ("Platform"). This includes our website, mobile applications, and any associated digital services.
Important: By accessing or using the Platform, you acknowledge and agree to be bound by these Terms, along with our Privacy Policy and other applicable policies. If you do not agree, please discontinue use of the Platform immediately.
2. Definitions
User (Passenger): A natural person using the Platform to browse listings and contact Drivers.
Driver: An independent third-party who lists transportation services on the Platform.
Listing: Any post or profile by a Driver offering transportation services.
Platform: The classified app and web interface known as Ride With Driver, operated by the Company.
3. Nature of Services
The Platform is an online classifieds interface only. We act solely as a digital connector between Users and Drivers. Specifically:
- The Company does not provide, operate, or manage any transportation services.
- We do not collect, accept, or process payments for or on behalf of Drivers.
- We do not mediate, negotiate, or enforce any contracts between Users and Drivers.
- Any communication or agreement you enter into with a Driver is strictly between you and that Driver.
Example: If you contact a Driver and schedule a ride, the Company is not a party to that arrangement and accepts no liability for any aspect of the service.
4. User Eligibility
To use the Platform, you confirm:
- You are at least 18 years of age.
- You are legally competent to enter binding agreements.
- You have a valid mobile number for OTP-based verification.
Any account found in violation (e.g., underage or impersonated identity) may be suspended or deleted.
5. User Account and Verification
- Browsing listings is available without registration.
- To contact Drivers, OTP verification is required.
- You are responsible for the confidentiality of your mobile device and OTP.
- Misuse, unauthorized access, or credential sharing may result in account termination.
6. Scope of User Responsibilities
By using the Platform, you agree to:
- Use it lawfully and fairly for personal transportation needs.
- Refrain from spam, promotional abuse, or misusing Driver contact details.
- Promptly report any abusive, misleading, or suspicious activity.
7. Acceptable Use Policy
You agree not to engage in:
- Harassment, threats, or impersonation.
- Uploading harmful code, malware, or unauthorized content.
- Using bots or scripts to scrape listings or contact multiple Drivers automatically.
- Posting misleading reviews or false information.
Example: Sending unrelated business ads to Drivers via contact tools is prohibited and will lead to account suspension.
8. Search, Contact & Communication
- You may use filters to browse and contact Drivers that suit your needs.
- All communication, pricing, and negotiation happens off-platform.
- The Company is not responsible for any pricing disputes, cancellations, or communication breakdowns between you and the Driver.
Example: If a Driver gives you a quote and later changes it, the Company has no involvement and cannot intervene.
9. Service Availability and Limitations
- Listings and service provider availability may vary by location and time.
- We may update, restrict, or discontinue features without prior notice.
- Access may be temporarily limited for maintenance or unforeseen issues.
10. Payments and Financial Interactions
Important Note: The Company does not collect any payment from Users/Passengers. Any payments made to Drivers are handled independently and entirely outside the Platform.
If, in the future, we offer optional premium features, these will be separately governed by appropriate terms and clearly communicated.
11. Platform Disclaimers
We do not:
- Guarantee the identity, license, or background of any Driver.
- Validate the accuracy, reliability, or legality of Listings.
- Guarantee the outcome of your communication or agreement with any Driver.
12. Limitation of Liability
To the maximum extent permitted by law, the Company is not liable for:
- Damages, injuries, delays, losses, or misconduct during transportation.
- Miscommunication, fraud, or disputes between Users and Drivers.
- Data loss, service outages, or technical malfunctions on the Platform.
13. Indemnification
You agree to indemnify and hold harmless the Company, its affiliates, officers, and agents from any claims, losses, or liabilities resulting from:
- Your use or misuse of the Platform
- Breach of these Terms
- Any third-party claims based on your conduct or agreements made with Drivers
14. Suspension and Termination
Your access to the Platform may be suspended or permanently terminated if you:
- Violate these Terms
- Engage in illegal, fraudulent, or abusive behavior
- Receive repeated verified complaints from other Users or Drivers
15. Intellectual Property Rights
All intellectual property (e.g., design, content, graphics, logos) on the Ride With Driver platform is the property of 99 Dollar Holidays Pvt. Ltd. You may not copy, modify, or distribute it without prior written permission.
16. Links to Third-Party Sites
The Platform may include links to third-party websites or tools. The Company:
- Has no control over those sites
- Is not responsible for their content, terms, or policies
- Recommends you review their policies before interacting
17. Force Majeure
We are not liable for failure to perform obligations due to events beyond our control, such as:
- Natural disasters
- Governmental restrictions
- Internet disruptions
- Pandemics or public health emergencies
18. Grievance Redressal and Dispute Resolution

- We aim to respond within 24 hours and resolve issues within 15 business days
- If unresolved, disputes shall be resolved by arbitration in New Delhi under the Arbitration and Conciliation Act, 1996
- Arbitration decisions are final and binding
19. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Courts located in New Delhi shall have exclusive jurisdiction over any dispute, unless resolved via arbitration.
20. Updates to Terms
The Company reserves the right to revise these Terms at any time. We will notify Users via the Platform or registered email. Continued use after such updates constitutes your acceptance.
